However, in most cases in Florida, you can keep your home and other exempt property, including retirement funds such as 401ks, IRAs, and qualified pension plans, and an automobile with minimal equity. Certain debts are non-dischargeable, such as child / spousal support, certain taxes, and most student loans. Chapter 11 allows businesses to reorganize their debt while continuing business operations. The court can forgive all or a portion of a business’s debt. Chapter 11 is very complicated and very costly and should be undertaken with caution. If you are ineligible to file for Chapter 7 bankruptcy because of your income, you can still file under Chapter 13. While Chapter 13 is more painful in that you may be required to pay back a portion of your debt through a payment plan, foreclosures on your home can be halted. Additionally, since you will generally be expected to pay back a portion of your debt according to your income and the value of your assets, your car, furniture, and other personal property may be retained in most cases.
